Apologists for torture argue the there should be no investigations and no prosecutions because the criminals felt justified in breaking the law. We should let bygones be bygones, “look forward”, and focus on the present. Their argument applies equally well to disbanding the entire criminal justice system. We prosecute, not just to punish past crimes, but to deter future crimes.
